TERMS AND CONDITIONS :: Part 2
Disclaimer
If you are a consumer, as defined by the Trade Practice Act 1974, these terms and conditions will include implied terms and conditions. You should not interpret anything in these terms and conditions as modifying any term or condition which is implied by the Trade Practices Act.
Except for the terms and conditions which are implied by the Trade Practices Act, GPI
- Make no express or implied warranty or representation in connection with the rewards (including with respect to type, quality, standard or fitness for any purpose)
- Is not liable for any loss you suffer (including consequential loss) arising in connection with a reward (including a failure to provide a reward, its loss, theft or destruction)
- Is not liable for any loss you suffer (including consequential loss) in connection with our negligence or our breaching a term, warranty or condition in relation to the Program.
Where GPI are liable for a breach of these terms and conditions, then our liability will exclude any indirect or consequential loss you may suffer. Our liability is limited to
- Where the reward constitutes goods, replacement or repair of the goods or payment of the cost of replacing or repairing the goods, or
- Where the reward constitutes a service, supplying the service again or payment of the cost of having the service supplied again.
If a reward is covered by a manufacturer’s warranty and requires service, you should contact the manufacturer named in the warranty information.
Our failure to enforce a term of these terms and conditions does not mean we waive that term.
Changes to these terms and conditions and the Powerpoints Rewards Program
We may change the terms and conditions of the PPRP at any time.
Changes may include a change to:
- The available rewards
- The way you can earn points
- The way you can redeem points
- The number of points required to obtain a reward
- The number of points you receive
- Those persons who are redemption partners
We will notify you of any material changes to these terms and conditions by giving you written notice via email no later than 30 days before the change takes effect.
We may transfer some or all of our rights and obligations under these terms and conditions to another person or legal entity at any time. You agree that you consent to such transfer when you (or additional member) continue to earn points after we notify you of the transfer.
Termination
We may terminate Powerpoints Rewards Program at any time.
We will notify you as soon as practicable of the termination and the time period in which you may use your points to claim rewards (which will be at least 90 days from the date we tell you that Powerpoints is discontinued). (See “How long do you have to use your points?)
GPI’s Role
GPI will ensure that we perform all of its obligations to you under these terms and conditions.
Interpretation
In these terms and conditions:Member means your Company and the authorised nominated person
Powerpoints means the points earned under rewards program operated by GPI on these terms and conditions
PowerPoints Rewards Program (PRPP) means the PowerPoints Rewards Program operated by GPI Apparel & Concepts Pty Ltd - ABN:44 848 392 419.
Supplier means agent providing merchandise as shown in the Powerpoints Rewards Program brochure and web site
GST means a goods and services tax, value added tax, consumption tax, or any similar tax or a tax on services only.
Redemption partner means us or any other person who agrees to provide rewards or bonuses in connection with Powerpoints.
We or us means GPI Apparel & Concepts Pty Ltd
You means the person in whose name the company registers as having authority over the Powpoints Rewards Program for their company.
GPI – means any reference to either or all of GPI Apparel & Concepts Pty Ltd, GPI Automotive Products Pty Ltd, GPI Sports & Fitness Pty Ltd or GPI McKay Pty Ltd.
The singular includes the plural and vice versa.
A reference to anything includes the whole and each part of it
A reference to a person includes their permitted successors and assigns.
The words “include”, “including”, “for example” or “such as”, do not limit the meaning of the words preceding them to that example or examples of a similar kind.
